The Delhi High Court observed that refusing to marry a woman on the ground of non matching kundalis after establishing physical relations can attract criminal charges.

Justice Swarana Kanta Sharma made the observation while denying bail to a man accused in a rape case registered under Section 376 of the Indian Penal Code and Section 69 of the Bharatiya Nyaya Sanhita.
According to the complaint, the accused maintained a long term relationship with the woman and repeatedly assured her that they would marry. On the basis of these assurances, the complainant entered into a consensual physical relationship with him.
The court noted that material placed on record, including WhatsApp chats, indicated that the accused had earlier told the woman that their horoscopes matched and that there were no obstacles to their marriage.
However, he later refused to marry her, citing horoscope incompatibility. The court found this position inconsistent with his earlier representations. It observed that if kundali matching was truly decisive, the issue should have been settled before entering into a physical relationship.
On these grounds, the court rejected the bail plea, stating that the allegations warranted continued investigation and judicial scrutiny.
