The rent agreement signed by students at a paying guest accommodation in Delhi’s Satya Niketan contained a clause stating that the PG authorities would not be responsible for casualties or risks to students.
A separate terms-and-conditions document also said the hostel would not be liable for injuries or loss of belongings caused by events beyond its control, including fire, earthquakes and heavy rain.
The building collapsed while renovation work was underway, killing seven people. MCD officials said it was nearly 50 years old and had permission for two floors, but had five floors when it collapsed. Officials also said there was no approved building plan.
The PG owner, Hariram Bansal, his wife Urmila and son Mahesh were arrested in connection with the case.
A contractual clause does not by itself determine legal liability. That will depend on the investigation into the building, construction work and alleged violations.
