A phone call with a male friend became the focus of a family dispute in Gujarat’s Kutch district. But what followed, according to a 14-year-old girl’s complaint, went far beyond an argument at home.
The teenager has made serious allegations against her parents, leading to a police case under the POCSO Act.
What happened inside the house, how did the teenager seek help, and what did the police find during the investigation?

How It Started?
According to the girl’s complaint, the incident began in September.
She was allegedly speaking to a male friend when her mother noticed the conversation. The mother reportedly told the girl’s father that she was talking to a boy and was in a relationship with him.
The girl told police that her father then became angry. She alleged that he assaulted her, confined her inside the house and, at one point, did not give her food for a day.
The rape allegedly began soon after. Police said the girl accused her father of raping her repeatedly over roughly a fortnight in the second half of September.

What Happened At Home?
The girl told police that the alleged assaults happened multiple times.
According to her account, she was physically assaulted before some of the alleged incidents. She also alleged that her mother was present during the abuse.
The girl was not simply confined once, according to the complaint. She allegedly remained under restrictions at home and had limited access to a phone, making it difficult for her to seek help.
The timeline became more serious when she tried to contact the police herself.
How She Managed To Seek Help
On 30 September, the girl allegedly reached a relative’s home in the same housing complex and tried to contact the police. Her parents allegedly took away the phone, switched it off and made her return home.
The girl then alleged that another incident took place on 1 October, during which her mother allegedly took nude photographs. Police later seized the mother’s phone and said they found photographs that supported parts of the girl’s allegations.
After this, the girl again managed to leave the house and reach a relative. This time, she called the 112 emergency helpline and gave the police her address.
Police personnel reached the house and rescued her, according to Kutch East Police. The parents were subsequently arrested after an FIR was registered, Deputy Superintendent of Police Mukesh Chaudhary said. Police also said the evidence recovered from the mother’s phone corroborated parts of the girl’s account.

What Does The Law Say?
Because the girl is 14, the case falls under the POCSO Act, which specifically protects children below 18 from sexual offences.
The law separately recognises penetrative sexual assault and aggravated penetrative sexual assault. Section 5 of POCSO covers aggravated circumstances, including sexual assault by certain persons in positions of authority or trust. The Act also contains provisions dealing with abetment and the use of children for pornographic purposes.
The police have registered the case under POCSO and other relevant provisions. The exact offences and sections applicable to each accused will depend on the investigation and the evidence collected.
The Bharatiya Nyaya Sanhita, which came into force on 1 July 2024, also contains provisions dealing with offences such as wrongful confinement and assault.

The Bigger Question Is What Happens Inside Homes
The case raises a difficult question about child safety.
A child may have limited control over what happens inside the home, particularly when the alleged abusers are people she depends on for food, shelter and safety.
Here, the allegations also involve repeated confinement and an alleged attempt to stop the girl from contacting the police.
That makes access to outside help critical.
The girl's eventual 112 call brought police to the house and led to her rescue. The investigation will now have to establish what happened, examine the digital evidence and determine the criminal liability of each accused.
The allegations are serious, but the final determination of guilt will be made through the legal process.
